Terms of Service

These Terms govern your use of Apnealytics (the “Service”), operated by Creative Labs LLC (“we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
Not a medical device. Apnealytics is a personal tracking and coaching tool. It does not provide medical advice, diagnosis, or treatment, and machine-estimated metrics (such as AHI) are not a clinical diagnosis. Always consult a licensed clinician about your therapy, and never disregard or delay professional medical advice because of something you saw in the Service. In an emergency, call your local emergency number.
1. Eligibility
You must be at least 13 years old to use the Service, and able to form a binding contract. If you use it on behalf of a family member, you’re responsible for their use and for having the right to add their data.
2. Your account
You’re responsible for activity under your account and for keeping access to your email secure (sign-in uses magic links, an optional password, and optional Google sign-in). Tell us promptly at info@apnealytics.com if you suspect unauthorized use. You can sign out or revoke sessions at any time.
3. Your data
Your therapy data and uploads are yours. You grant us a limited license to store and process them solely to operate the Service for you (parse files, compute metrics, render your dashboard). We handle them as described in the Privacy Policy, including per-account isolation and private file storage. You can export or delete your data at any time.
4. Acceptable use
Don’t misuse the Service: no attempting to access other users’ data, probing or bypassing security or rate limits, scraping, reverse-engineering, reselling access, uploading malware, or using the Service unlawfully. We may suspend accounts that put the Service or other users at risk.
5. Subscriptions & billing
Some features may require a paid plan. Where billing applies, payments are processed by Stripe; fees, renewal, and cancellation terms are shown at checkout. Except where required by law, payments are non-refundable. We may change prices with notice; changes don’t affect the current paid period.
6. Third-party services
The Service relies on third parties (e.g., hosting, database, file storage, email, payments, error monitoring) and can integrate with Apple Health/Health Connect and Google sign-in if you choose. Your use of those is subject to their terms; we’re not responsible for third-party services.
7. Service availability & changes
We work to keep the Service available but don’t guarantee uninterrupted or error-free operation, and we may modify or discontinue features. We’ll give reasonable notice of material changes where practical.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and including any warranty that the Service is suitable for medical or diagnostic use. See the medical disclaimer above.
9. Limitation of liability
To the maximum extent permitted by law, Creative Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any health outcome or decision made in reliance on the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the 12 months before the claim (or USD $100 if you paid nothing).
10. Indemnification
You agree to indemnify Creative Labs LLC against claims arising from your misuse of the Service or violation of these Terms.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive (data ownership, disclaimers, liability limits) survive termination.
12. Changes to these Terms
We may update these Terms; we’ll post a new effective date and, for material changes, notify you. Continued use after an update means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, excluding its conflict-of-laws rules, and disputes will be handled in the courts located there, unless applicable law requires otherwise.
